A valued client, who recently moved to Luxembourg with their family under the “Private Life” programme, approached us with a challenging request.
Client: “I have an adult son from a previous marriage. He’s 27 years old, and I want him to join our family here in Luxembourg.”
Ziffer: Given his age, obtaining a residency permit through “Private Life” is only possible in very exceptional circumstances.
After discussing the specific cases allowed by law, we realised that, unfortunately, none of them seemed applicable.
Ziffer: What if we consider the option of your son achieving residency through employment in Luxembourg?
However, after reviewing the legal requirements, we concluded that, in this particular case, given the absence of professional qualifications and work experience, it would be unrealistic to pursue this option.
Nevertheless, the client was determined to try the “Private Life” route to bring their son to Luxembourg and asked for our support.
Although the legislation and our extensive experience in handling residency cases in Luxembourg indicated that the chances of success were minimal, we were committed to assisting our client. We took the time to thoroughly understand the family’s background, helped articulate the situation, and gathered compelling evidence to support the need for family reunification. We stayed in constant communication with the client and the Luxembourgish authorities, fostering a constructive dialogue and assisting with the preparation of additional documentation.
Thanks to the Luxembourg authorities’ flexibility and openness to dialogue, the client’s trust in our team, and our combined efforts, experience, and dedication, this “Mission Impossible” was successfully completed.
